These Terms of Service ("Terms") constitute a binding agreement between AeroVision Labs Pty Ltd (ABN [insert]) ("AeroVision Labs", "we", "us", "our") and any person ("you", "your") who accesses or uses our website, Android application, or related services ("Services").
1. Acceptance of Terms
1.1 By creating an account, accessing, or using the Services, you acknowledge and agree to be bound by these Terms.
1.2 If you do not agree with these Terms, you must not access or use the Services.
2. Accounts
2.1 You warrant that the information you provide at the time of registration is accurate and complete.
2.2 You must maintain the confidentiality of your login credentials and are solely responsible for any activity undertaken using your account.
2.3 Accounts are personal to the registered user and may not be assigned, transferred, or shared.
3. Subscriptions and Access
3.1 Certain features of the Services require an active paid subscription.
3.2 Subscription entitlements may be limited to a defined number of devices. Device serial numbers and login records will be monitored for enforcement of such limitations.
3.3 AeroVision Labs reserves the right to suspend or terminate access in the event of misuse, breach of these Terms, or non-payment of subscription fees.
4. User Content
4.1 You may, at your discretion, elect to contribute images and/or videos captured by your drone. By doing so, you grant AeroVision Labs a perpetual, irrevocable, royalty-free, worldwide, non-exclusive licence to use, reproduce, modify, and create derivative works from such content solely for the purposes of research, development, and improvement of AI models.
4.2 You represent and warrant that you hold all necessary rights in any content you submit and that such submission does not infringe the rights of any third party.
4.3 You may withdraw from further contribution of content at any time; however, any content previously submitted shall continue to be used under the licence granted herein.
5. Prohibited Conduct
5.1 You must not:
(a) use the Services for unlawful purposes or in contravention of aviation regulations (including those of the Civil Aviation Safety Authority (CASA));
(b) attempt to reverse engineer, decompile, or otherwise extract source code or models from the Services;
(c) circumvent subscription restrictions or otherwise engage in unauthorised access or use; or
(d) engage in conduct that, in the reasonable opinion of AeroVision Labs, interferes with the proper functioning of the Services.
6. Availability and Modifications
6.1 AeroVision Labs provides the Services on an "as is" and "as available" basis. No representation, warranty, or guarantee of uninterrupted access, error-free operation, or suitability for any purpose is given.
6.2 AeroVision Labs may, at its sole discretion, modify, suspend, or discontinue any part of the Services at any time without liability.
7. Limitation of Liability
7.1 To the maximum extent permitted by law, AeroVision Labs disclaims all liability for any direct, indirect, incidental, or consequential loss or damage arising in connection with the Services.
7.2 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
8. Termination
8.1 AeroVision Labs may suspend or terminate your account and/or access to the Services at any time for breach of these Terms or where continued use would, in our reasonable opinion, be detrimental to AeroVision Labs, its systems, or other users.
8.2 You may terminate your account at any time by providing written notice to AeroVision Labs.
9. Governing Law and Jurisdiction
9.1 These Terms are governed by the laws of Queensland, Australia.
9.2 You irrevocably submit to the exclusive jurisdiction of the courts of Queensland and any courts that may hear appeals from those courts.
